1. Agreement to Terms
By accessing or using CompetitionAds.com ("the Service"), owned and operated by adyntel, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
2. Service Description
CompetitionAds.com provides a Google Chrome extension that displays estimated ad spend data from the Meta Ad Library. Our Service:
- Surfaces publicly available data from Meta's Ad Library
- Calculates and displays estimated ad spend information
- Provides subscription-based access to enhanced features
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.
3. User Accounts and Registration
To access certain features of the Service, you may be required to create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your password and account
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
You are responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from your failure to comply with this section.
4. Subscription and Billing
Free Trial
We offer a 14-day free trial period for new subscribers. During the trial period, you will have full access to the Service. No charges will be made during the trial period, but you must provide a valid payment method to begin the trial.
Subscription Plans
After the trial period ends, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. Subscription fees are billed in advance on a monthly basis. All fees are non-refundable except as required by law.
Payment Processing
Payments are processed through Stripe, a third-party payment processor. By providing payment information, you agree to Stripe's terms and conditions. We do not store your complete payment card information on our servers.
Cancellation and Refunds
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period. You will continue to have access to the Service until the end of the period you have paid for. Refunds are not provided for partial billing periods.
Price Changes
We reserve the right to modify subscription prices at any time. Price changes will not affect your current subscription period but will apply to subsequent billing cycles. We will notify you of any price changes in advance.
5. Acceptable Use
You agree not to use the Service:
- For any unlawful purpose or to solicit others to perform unlawful acts
- To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
- To infringe upon or violate our intellectual property rights or the intellectual property rights of others
- To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
- To submit false or misleading information
- To upload or transmit viruses or any other type of malicious code
- To collect or track the personal information of others
- To spam, phish, pharm, pretext, spider, crawl, or scrape
- For any obscene or immoral purpose
- To interfere with or circumvent the security features of the Service
We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.
6. Intellectual Property Rights
The Service and its original content, features, and functionality are owned by adyntel and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service without our prior written consent.
The CompetitionAds name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of adyntel or its affiliates. You must not use such marks without our prior written permission.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will meet your requirements
- The Service will be uninterrupted, timely, secure, or error-free
- The results obtained from the use of the Service will be accurate or reliable
- The quality of any products, services, information, or other material obtained through the Service will meet your expectations
The ad spend estimates provided by our Service are estimates only and should not be relied upon as exact figures. We make no representations or warranties regarding the accuracy of these estimates.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ADYNTEL, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.
UNDER NO CIRCUMSTANCES WILL ADYNTEL BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ADYNTEL ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; PERSONAL INJURY OR PROPERTY DAMAGE; ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS; ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE; OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF THE SERVICE.
9. Indemnification
You agree to defend, indemnify, and hold harmless adyntel and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Service, by you or any person using your account and password, or a violation of these Terms.
10. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
If you wish to terminate your account, you may simply discontinue using the Service or cancel your subscription through your account settings.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11. Governing Law
These Terms shall be interpreted and governed by the laws of the jurisdiction in which adyntel operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
13. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
